Yes, reserve studies are mandatory in Florida according to Senate Bill 4-D (SB-4D), which was passed in May 2022 in response to the Champlain Towers South condominium collapse in Surfside. The law requires condominium and cooperative associations with three or more stories in height to have a reserve study performed every 10 years.
The reserve study must be submitted to the local enforcement agency and to all unit owners and renters.
If an association fails to have a reserve study performed, they may be subject to fines or other penalties.
